According to federal law and IRS regulation, ECCA should withhold thirty percent (30%) of the gross rental income from homeowner so as to avoid personal liability (Unless the foreign homeowner submits to the property manager with a fully completed Internal Revenue Service Forms W-8ECI: Certificate of Foreign Person’s Claim for Exemption From Withholding on Income Effectively Connected With the Conduct of a Trade or Business in the United States). Withholding tax is calculated by total gross income (30% of total gross income). Normally, if homeowner’s statement of current month has positive balance (after calculating withholding tax), we will transfer to homeowner at the beginning of next month. For example, Tenant pays rent for month March, ECCA needs using the money for payment of different charges.
